Terms Conditions and Transportation Waiver

Activity: Passenger Ground Transportation

            I, the person responsible for making this reservation, fully understand that traveling involves risks and dangers of serious bodily injury, including permanent disability, paralysis, and death; these risks and dangers may be caused by my own actions or inactions, the actions and inactions of other drivers or passengers; there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and as between myself and Dominion Shuttle, I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I may incur as a result of my patronage and/or use of the transportation service.

            I hereby release, discharge, and covenant not to sue DOMINION, LLC d/b/a Dominion Shuttle, its administrators, directors, agents, officers, partners, volunteers and employees (“Releasees”) from any and all liability, claims, demands, losses or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise and I further agree that if, despite this release and waiver of liability, assumption of risk and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify,  save and hold harmless each of the Releasees, from any litigation’s expenses, attorney fees, loss, liability, damage, or cost which may incur as a result of such claim.

TRANSPORT RULES AND DISCLOSURES                        

i.     Positive state or federal issued ID will be required to board the shuttle.

ii.    Unaccompanied minors will not be permitted to board. Under Alabama law, a minor is a person younger than 19 years old, unless such a person has been emancipated.

iii.  Dominion Shuttle reservations are non-transferrable. Customers may request to cancel their reservation by doing so online, by leaving a voice mail at (334) 687-0404 or by sending an email to Info@DominionShuttle.com for a full refund up until 24 hours prior to scheduled departure time, after which no refunds will be issued. If you book your reservation less than 24 hours prior to scheduled departure, you will not be eligible for a refund. Administrative and processing fees are non-refundable. This refund policy does not extend to chartered services. All cancellations are based on Eastern Standard Time.

iv.   Late Arrival: Dominion Shuttle will not delay the shuttle for any passenger(s) who arrive to any point of origin (pick-up location) late.

v.    Risk of late arrival: Dominion Shuttle will take precautions to provide backup transportation in case of mechanical problems. There is always a risk that the shuttle may be late to its destination of stops.  I acknowledge and accept this risk.

vi.   Due to potential exposure to airborne illnesses, Dominion Shuttle strongly suggests that passengers wear a mouth and nose covering prior to boarding the shuttle and throughout the duration of transport. Face coverings with outward ventilation holes are not recommended.

vii. Passengers who present without a face covering but desire to utilize one may be provided with one at a nominal cost. All fees for requested face covering must be paid on demand.

viii.  Individuals may opt not to wear a face covering; however, Dominion Shuttle will not be responsible for your well-being and will be held harmless.

ix.   No fighting, horse playing, wrestling, or the use of profane language is allowed on the shuttle.

x.    No eating is permitted onboard the shuttle.

xi.   Food and beverage may be transported in spill proof containers for consumption outside the vehicle.

xii. No alcohol or alcoholic beverages are allowed on the shuttle. Vaping, or the smoking of tobacco products, or the smoking of marijuana, or the taking of any illicit drugs are strictly forbidden onboard the shuttle.

xiii.     Service animals are allowed on the shuttle at no additional charge. To accommodate space, prior written notice and identification must be provided to Dominion Shuttle for approval.

xiv.    Service Animal Defined: A service animal is any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability. A service animal must have a harness, leash, or other tethers unless the handler is unable to use a tether because of a disability or the use of a tether would interfere with the service animal’s ability to safely perform its work or tasks. In these cases, the service animal must be under the handler’s control through voice commands, hand signals, or other effective means. Other species of animals, whether wild or domestic, trained, or untrained, are not considered service animals.

xv.  Each passenger may board with one bag up weighing up to 50 lbs., one carry-on bag, and one personal item at no additional cost, subject to vehicle capacity. Please call ahead to make arrangements for oversized or additional luggage (which may incur additional fees). Any belongings or articles that may cause harm or damage to passengers will not be accepted.

xvi.   Personal belongings are not inspected by Dominion Shuttle and Dominion Shuttle will not be held responsible for transportation of contraband or any other illegal items that may be concealed by passengers.

xvii.    Any and all weapons, of any kind, are strictly prohibited and are not permitted onboard the vehicle. This includes weapons, such as guns, where a passenger may legally possess a concealed carry permit.

xviii.   Dominion Shuttle reserves the right to refuse boarding to persons who may be intoxicated by liquor, drugs, or who is incapable of taking care of himself or herself, or who shows conduct, which is such, or likely to be such, as to make him or her objectionable to other passengers serviced by Dominion Shuttle.

xix.   Dominion Shuttle will not be liable for any loss or damage to a passenger’s personal belongings unless such loss or damage is caused by Dominion Shuttle and then only for the reasonable value thereof.

xx.  Booking person assumes full responsibility for all persons under his/her reservation and liability for the conduct resulting in the physical damage to Dominion ’s equipment.

xxi.  The Phenix City location is for loading and unloading only. Customers are NOT to leave their vehicles. Vehicles left unattended are subject to towing at owner’s expense.

COVID-19 WAIVER                                                                                                                    

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and possibly by contact with contaminated surfaces and objects or in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known cure, for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.

Dominion Shuttle cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 or any other communicable disease while utilizing Dominion’s services. It is not possible to prevent against the presence of any communicable disease. Therefore, if you choose to utilize Dominion’s services you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19 or any other communicable disease.

 xxii.      Assumption of Risk                                                                                              

I have read and understand the above warning concerning COVID-19 and communicable diseases. I hereby choose to accept the risk of exposure for myself in order to utilize Dominion’s services. I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize Dominion’s services.

 xxiii.    Waiver of Lawsuit/Liability

I hereby forever release and waive my right to bring suit against DOMINION, LLC d/b/a Dominion Shuttle and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 or other communicable diseases related to utilizing Dominion’s services. I further understand that this waiver means I give up my right to bring any claims, including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

ENTIRE AGREEMENT                                                                                                              

This Agreement contains the entire understanding of the obligations of the Parties. There are no other promises, agreements, warranties, or representations other than those expressly stated in this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, all other provisions of this Agreement remain in full force and effect indefinitely.

By proceeding to confirm a reservation for transport with DOMINION SHUTTLE, you affirm that you have read all the above conditions, terms, and waivers, AND you understand the conditions, terms, and waivers above AND agree to be governed by all of the above conditions and waivers as stated herein. These conditions and waivers extend to all persons under your booking confirmation. Do no proceed with a booking if you do not agree to be bound by these conditions, terms and, waivers. No refunds will be given for a passenger’s non-compliance with any stated terms.
